1. Overview and Acceptance
These Terms of Service (Terms) govern access to and use of the official Mt. Baker Mining and Metals online store at mbmmllc.myshopify.com, including its website, content, accounts, checkout, products, customer-service functions, and related services (collectively, the Services).
The Services are operated by Mt. Baker Media, LLC, which conducts store transactions for the Mt. Baker Mining and Metals (MBMM) brand. In these Terms, Mt. Baker Media, LLC, MBMM, we, us, and our refer to Mt. Baker Media, LLC as the store operator. You and your refer to the person accessing or using the Services or placing an order.
By accessing the Services, creating an account, submitting an order, or otherwise using the Services, you agree to these Terms and to the policies incorporated by reference, including the Privacy Policy, Shipping Policy, and Refund and Return Policy.
If you do not agree, do not use the Services or place an order.

3. Eligibility and Authority
You must be at least the age of majority in your state of residence and legally capable of entering a binding agreement to purchase through the Services.
If you use the Services for a business, organization, or another person, you represent that you have authority to bind that business, organization, or person to these Terms.
Products requiring tools, mineral processing, cutting, crushing, heating, smelting, chemicals, or other hazardous activity are intended for knowledgeable adults. A minor may not purchase or process those products without lawful adult supervision.
4. Accounts and Information You Provide
Some features may allow or require an account. You agree to provide current, complete, and accurate information and to update it when necessary.
You are responsible for:
maintaining the confidentiality of account credentials;
activity occurring through your account;
providing accurate billing, payment, contact, and shipping information; and
notifying us promptly if you suspect unauthorized access.
You may not transfer, sell, or license an account to another person.
5. Products and Product Descriptions
We make reasonable efforts to describe products accurately. Product pages may include photographs, video, measurements, weights, localities, mineral identifications, condition information, and other descriptions.
Because products may include natural ore, rocks, minerals, specimens, lapidary items, and handmade or small-production goods:
color may vary with lighting, screen calibration, and viewing conditions;
dimensions and weights may be approximate unless expressly stated otherwise;
natural features and composition may vary;
labels or locality information may reflect the best information reasonably available; and
minor typographical or descriptive errors may occur.
If a product page identifies photographs as exact-item photographs, the photographs are intended to show the individual product offered. If photographs are identified as representative, they show examples of the source or general material and do not depict the exact contents of every order.
We may correct a product description, price, image, inventory status, or other information at any time. If a material correction affects an unfulfilled order, we may contact the customer, offer an appropriate alternative, or cancel and refund the order.
6. Natural Materials and Variation
Ore, rock, minerals, and mineral specimens are natural materials and are not uniform manufactured goods.
Natural variation can include differences in:
color and luster;
mineralization and host rock;
oxidation and weathering;
crystal form and visibility;
fracture and cleavage;
particle size and fines;
moisture and surface dust;
weight distribution; and
response to crushing, concentration, assay, cutting, polishing, heating, or other processing.
Natural variation is not a defect when the delivered product is materially consistent with the listing and disclosed product type.
7. Gold, Silver, Telluride, and Mineral-Content Disclosures
Unless a product page expressly provides a specific written guarantee or a documented assay applicable to the exact product, we do not guarantee:
visible gold, silver, tellurides, or any other visible mineral;
mineral species or identification beyond the description stated with reasonable qualification;
a particular grade or concentration;
a particular amount of recoverable metal;
a particular assay result;
a particular metallurgical recovery;
a particular processing outcome;
a particular resale, collector, investment, or monetary value; or
profit from processing or reselling the product.
Bulk ore is sold as natural geological material. It is not bullion, a security, a financial product, concentrated paydirt, or a guaranteed source of precious-metal recovery or profit.
A result shown in a video, assay, test, demonstration, or prior batch does not guarantee the result of a different sample or order unless the product page expressly states that the result is guaranteed for the exact product purchased.
8. Mineral Identification and Locality Information
Mineral identification may be based on field observations, appearance, mine information, prior testing, supplier information, or analytical results. Unless a listing states that a specific laboratory method was performed on the exact item, an identification should not be interpreted as a laboratory guarantee.
Locality or mine attribution is provided according to the information reasonably available. Historical labels, collector records, seller information, and field provenance may contain uncertainty. When uncertainty is known and material, we will attempt to disclose it.
9. Product Safety and Responsible Use
Natural ore and minerals may contain crystalline silica, sulfides, heavy metals, arsenic-bearing minerals, sharp edges, or other naturally occurring constituents and hazards.
You are responsible for evaluating the suitability and safety of your intended use, including the need for:
safety glasses or face protection;
suitable gloves and clothing;
respiratory protection selected and used under an appropriate program;
wet methods, local exhaust, or other dust controls;
fire-resistant work areas;
ventilation and fume control;
safe chemical handling and waste disposal;
guards and safe operating procedures for machinery; and
compliance with occupational, environmental, fire, transportation, and other laws.
Do not ingest mineral products or use them in food, beverages, cosmetics, medicine, or children's products. Keep them away from food-preparation areas, children, and pets.
Crushing, grinding, cutting, drilling, sanding, heating, roasting, smelting, or chemical processing can produce hazardous dust, fragments, heat, fumes, gases, molten material, or waste. Such activities should be performed only by knowledgeable adults with appropriate equipment, controls, training, and lawful procedures.
Content on the Services is general educational information and is not professional mining, engineering, metallurgical, investment, medical, industrial-hygiene, environmental, or legal advice.
10. Availability and Product Limits
Products may be limited, one of a kind, seasonal, or available only in small quantities. Inventory information can change before the system updates.
We may limit quantities, discontinue a product, or restrict sales to a person, address, region, or jurisdiction when reasonably necessary for inventory control, fraud prevention, shipping feasibility, legal compliance, or safety.
11. Prices, Taxes, and Charges
Prices are shown in United States dollars unless otherwise stated.
Prices, discounts, and promotions may change without notice. The price applicable to an order is the price displayed when the order is submitted, subject to correction of an obvious error.
Shipping charges and applicable taxes are displayed during checkout before payment. Heavy products can have shipping costs that are material relative to the product price.
You are responsible for reviewing the complete order total before submitting payment.
12. Orders and Acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance.
We may accept, decline, hold, or cancel an order for reasons including:
product unavailability;
pricing or listing error;
inability to verify payment or contact information;
suspected fraud or unauthorized activity;
shipping infeasibility;
violation of these Terms;
legal or safety restrictions; or
a quantity limitation.
If we cancel an order after payment has been captured, we will issue a refund to the original payment method.
13. Payment and Fraud Review
Payment is processed through Shopify and authorized payment providers. You represent that:
the payment information is accurate;
you are authorized to use the payment method;
charges will be honored; and
you will pay the order total, including shipping and applicable taxes.
An order may be delayed or canceled while payment, identity, address, or fraud information is reviewed. We may request reasonable verification. Do not email complete payment-card information.
14. Shipping and Delivery
Orders are processed within up to 7 business days before shipment. Processing time is separate from carrier transit time.
The store ships to eligible addresses within the United States only. International shipping is not offered through the store.
Shipping methods, charges, estimated delivery times, address obligations, damaged-shipment procedures, missing-package procedures, and other terms are governed by the Shipping Policy, which is incorporated into these Terms.
Delivery dates are estimates and are not guaranteed. To the extent permitted by law, we are not responsible for carrier delays or events outside our reasonable control.
15. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, damaged-product claims, cancellation requests, return shipping, and product-condition requirements are governed by the Refund and Return Policy, which is incorporated into these Terms.
Eligible returns must be requested within 30 calendar days after confirmed delivery.
Bulk ore and other natural material is not eligible for a discretionary return after any portion has been removed, sorted, washed, crushed, panned, cut, polished, heated, smelted, chemically treated, partially used, or otherwise processed or materially altered.
16. Promotions, Discounts, and Gift Cards
A promotion, discount, coupon, or gift card may be governed by additional terms. Unless expressly stated:
promotions cannot be combined;
discounts do not apply retroactively;
promotions have no cash value;
promotions may be limited by product, customer, quantity, date, or inventory; and
we may correct or cancel a promotion affected by error, fraud, or abuse.
Gift cards are nonrefundable except where required by law.
17. Intellectual Property
The Services and their content, including text, photographs, graphics, logos, product descriptions, videos, audio, designs, trademarks, and arrangement, are owned by or licensed to Mt. Baker Media, LLC, Mt. Baker Mining and Metals, their affiliates, or their licensors and are protected by intellectual-property laws.
You may access the Services for personal, lawful, noncommercial shopping and informational use.
Without prior written permission, you may not:
reproduce, republish, distribute, sell, license, or commercially exploit store content;
remove copyright, trademark, or proprietary notices;
use photographs or video to market another product;
create a misleading association with MBMM or Mt. Baker Media, LLC; or
use automated tools to scrape or extract substantial portions of the Services, except as allowed by law.
All rights not expressly granted are reserved.
18. Reviews, Feedback, and User Submissions
If you submit a review, photograph, suggestion, testimonial, comment, or other content (Feedback), you represent that you have the right to submit it and that it is accurate, lawful, and not misleading.
You grant Mt. Baker Media, LLC a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from the Feedback for operating, improving, and promoting the Services and MBMM products, subject to applicable privacy law.
You may not submit content that:
infringes intellectual-property, privacy, publicity, or other rights;
is knowingly false or misleading;
is defamatory, threatening, harassing, obscene, or unlawful;
contains malicious code or spam; or
conceals compensation or a material connection when disclosure is required.
We may moderate or remove Feedback but are not required to do so.
19. Third-Party Tools, Links, and Content
The Services may include or link to third-party services, including Shopify, payment providers, shipping carriers, video platforms, social-media services, and external websites.
Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for their availability, accuracy, security, products, or practices.
Use of a third-party service is at your discretion and does not create a warranty or endorsement beyond what we expressly state.
20. Relationship With Shopify
Shopify provides the ecommerce platform that enables us to offer the Services. Purchases through this store are transactions between you and Mt. Baker Media, LLC, not between you and Shopify.
Shopify is not the seller of MBMM products and is not responsible for product descriptions, fulfillment, shipping, returns, or customer-service decisions made by Mt. Baker Media, LLC.
Nothing in this section limits rights you may have against Shopify under a separate agreement or applicable law.
21. Privacy
Personal information collected through the Services is handled under the Privacy Policy. Shopify and other providers may also process personal information under their own privacy terms.
By using the Services, you acknowledge that information may be transmitted to and processed by Shopify and other service providers as necessary to operate the store, process payment, prevent fraud, fulfill orders, and provide requested services.
22. Prohibited Uses
You may not use the Services:
for an unlawful, fraudulent, deceptive, or malicious purpose;
to violate a law, regulation, order, or third-party right;
to impersonate another person or misrepresent affiliation;
to transmit malware or harmful code;
to interfere with security or operation;
to scrape or harvest personal information unlawfully;
to conduct unauthorized advertising, spam, phishing, or pretexting;
to attempt unauthorized access to accounts or systems;
to submit false payment, identity, or delivery information; or
to purchase products for an unlawful use.
We may suspend access, cancel an order, or terminate an account when we reasonably believe a violation has occurred.
23. Errors, Inaccuracies, and Omissions
The Services may occasionally contain typographical errors, inaccurate inventory, incorrect pricing, broken links, or incomplete information.
We may correct an error, update information, or cancel an affected order at any time. If an order is canceled after payment, we will refund the amount charged for the canceled product and any applicable shipping or tax.
24. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED AS IS AND AS AVAILABLE.
EXCEPT FOR EXPRESS WRITTEN WARRANTIES PROVIDED ON A PRODUCT PAGE OR RIGHTS THAT CANNOT BE DISCLAIMED, MT. BAKER MEDIA, LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
PRODUCT IMAGES WILL APPEAR IDENTICALLY ON EVERY DEVICE;
NATURAL MATERIALS WILL BE UNIFORM;
A PRODUCT WILL PRODUCE A PARTICULAR ASSAY, RECOVERY, PROCESSING, COLLECTOR, OR FINANCIAL RESULT; OR
INFORMATION ON THE SERVICES WILL BE COMPLETE OR SUITABLE FOR A PARTICULAR PROFESSIONAL PURPOSE.
Some jurisdictions do not allow certain warranty limitations, so some limitations may not apply.
25. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MT. BAKER MEDIA, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFIT, LOST REVENUE, LOST DATA, LOSS OF BUSINESS OPPORTUNITY, OR COST OF SUBSTITUTE GOODS, ARISING FROM THE SERVICES OR A PRODUCT.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO MT. BAKER MEDIA, LLC FOR THE PRODUCT GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot legally be limited, including liability imposed by applicable product-liability or consumer-protection law.
26. Assumption of Risk for Processing Activities
To the extent permitted by law, you assume the risks inherent in voluntarily cutting, grinding, crushing, drilling, heating, roasting, smelting, chemically treating, or otherwise processing natural mineral material after delivery.
This section does not excuse a material defect or misdescription that existed at delivery and was not properly disclosed. It recognizes that processing activities can create hazards independent of the product's ordinary condition and can permanently change the product.
27. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Mt. Baker Media, LLC and its affiliates, owners, officers, employees, contractors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from:
your material breach of these Terms;
your unlawful use of the Services;
your violation of a third party's rights; or
your unsafe, unlawful, or unauthorized processing or resale of a product.
This obligation does not apply to the extent a claim results from the indemnified party's own negligence, misconduct, or violation of law.
28. Events Outside Reasonable Control
We are not responsible for a delay or failure caused by events outside our reasonable control, including severe weather, fire, flood, earthquake, wildfire, epidemic, government action, war, civil disturbance, carrier interruption, labor dispute, utility failure, cyberattack, supply interruption, or transportation disruption.
We will make reasonable efforts to address an affected order when practicable.
29. Suspension and Termination
We may suspend or terminate access to the Services, cancel an account, or decline future transactions when reasonably necessary to:
protect customers, personnel, systems, or property;
prevent fraud or abuse;
enforce these Terms;
comply with law; or
respond to conduct that materially harms the Services or another person.
Provisions that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, liability limitations, indemnification, governing law, and dispute provisions.
30. Severability
If a provision of these Terms is held unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted and severed to the minimum extent necessary. The remaining provisions will remain effective.
31. No Waiver
A failure to enforce a provision is not a waiver of that provision or any other right. A waiver must be in writing and signed by an authorized representative of Mt. Baker Media, LLC.
32. Entire Agreement
These Terms and the policies incorporated by reference constitute the entire agreement concerning the Services and store purchases, except for a separate written agreement expressly signed by an authorized representative of Mt. Baker Media, LLC.
33. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, financing, or transfer of the store or related business, subject to applicable law.
34. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
To the extent a dispute is not subject to a forum required by applicable consumer law, the parties consent to the jurisdiction of the state and federal courts serving Whatcom County, Washington.
Nothing in this section deprives a consumer of protections that cannot be waived under the law of the consumer's residence.
35. Changes to These Terms
We may update these Terms to reflect changes in law, business practices, Shopify features, products, or the Services.
The revised Terms will be posted on this page with an updated date. Material changes will receive additional notice when required by law.
Changes apply prospectively from the effective date unless law permits otherwise. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
